Update on Raub: Marine Kidnapped by Officials for Facebook Comments

Update: A local judge ordered the release of Raub August 23rd. According to Judge Sharrette, the involuntary commitment order issued by a magistrate against Brandon J. Raub was invalid and illegal because "it contained no allegation or basis to hold him." There was a groundswell of support for Raub when his apprehension was filmed and posted on YouTube. Unfortunately, many other veterans receiving the same unlawful treatment are not so fortunate.


Raub is a decorated Marine who served a tour in Afghanistan and one in Iraq. He was forcefuly escorted from his home in a most uncivilized manner, not even being allowed to put a shirt on, all because of some political and satirical comments he posted on Facebook. Glenn Beck, for one, was appalled that such an event would occur in America. Even if Glenn did not agree with Raub's political views, he said he would defend any person's right to voice their views. The lawyer who helped secure the release of Raub told the Alex Jones Show that there are currently a further 20 cases in his county alone that are similar in nature to Raub’s detention. According to The Rutherford Institute, "Whitehead stated that 20,000 people are committed under similar circumstances in Virginia annually." All this for the alleged insane belief that the historical actions of the US government should be open to being criticized and questioned.

The following text is from a copy of a Facebook post that Brandon Raub made in 2011 and given to CBS 6 by Raub’s mother:
The Truth

America has lost itself. We have lost who we truly are. This is the land of the free and the home of the brave.
This is the land of Thomas Jefferson.
This is the land of Benjamin Franklin.
This is the land of Fredrick Douglas.
This is the land of Smedley Butler.
This is the land John F. Kennedy.
This is the land of Martin Luther King.
This is the land where the cowboy wins. This is the land where you can start from the bottom and get to the top. This is the land where regardless of you race and ethnicity you can succeed and build a better life for you and your family. This is the land where every race coexists peacefully. This is the land where justice wins. This is the land where liberty dwells. This is the land where freedom reigns. This is the land where we help the poor, and people help each other. This is land where people beat racism.
The Federal Reserve is wrong. They have designed a system based off of greed and fear. They designed a system to crush the middle class between taxes and inflation. This is wrong, and it is unjust. It is wrong.
We have allowed ourselves to be deceived and seduced by the powers of the printing press. It is not a good system. It discourages saving: the foundation for all stable economic activity. The Federal Reserve is artificially manipulating interest rates and creating phony economic data.
This thing has deceived our entire nation.
They created it in 1913. They also created the income tax in 1913. They encouraged the growth of debt so they can tax you on it. There is interest on the debt. Your government is in bed with these people. They want to enslave you to the government so that they can control every aspect of your lives. It is an empire based on lies. They operate of greed and fear.
There is a better way. It’s called freedom. Freedom is called a lot of things. But there is a true meaning. It means very simply that you have the right to do whatever you want as long as you are not infringing on the freedoms of other people.
I firmly believe that God set America apart from the other nations of the world. He saved a place where people could come to to escape bad systems of goverment. This system we have created works. It really works.
There is evil going on all around the world. The United States was meant to lead the charge against injustice, but through our example not our force. People do not respond to having liberty and freedom forced on them.
Men and Women follow courage. They follow leadership, and courage. Our example has paved the way for people all around the world to change their forms of government.
Force is not the way because liberty is a powerful concept. The idea that men can govern themselves is the basis for every just form of government.
We can govern ourselves. We do not need to be governed by men who want to install a one world banking system. These men have machine hearts. Machine and unnatural hearts.
They have blocked out the possibility of a better world. They fear human progress. They have monopolies on everything.
This life can be free and beautiful. There are enough resources on this earth to support the world’s population. There are enough resources on this earth to feed everyone. There is enough land for everyone to own their own land and farm, and produce their own energy.
These people have been hiding technology. There are ways to create power easily. There is technology that can provide free cheap power for everyone. There are farming techniques that can feed the entire world.
The Bill of Rights is being systematically dismantled. Men have spilled their blood for those rights.
Your sons and daughters, your brothers and sisters, and Americas best young men and women are losing their limbs. They are losing their lives. They are losing the hearts. They do not know why they are fighting. They are killing. And they do not know why.
They have done some extraordinary acts. Their deeds go before them. But these wars are lies. They are lies. They deceived our entire nation with terrorism. They have gotten us to hand them our rights. Our Rights! Men died for those rights!
September Eleventh was an inside job. They blew up a third building in broad daylight. Building 7.
Your leaders betrayed you.
You elected an aristocracy. They are beholden to special interests. They were brainwashed through the Council on Foreign Relations. Your leaders are planning to merge the United States into a one world banking system. They want to put computer chips in you.
These men have evil hearts. They have tricked you into supporting corporate fascism. We gave them the keys to our country. We were not vigilant with our republic.
There is hope. BUT WE MUST TAKE OUR REPUBLIC BACK

As Dennis Behereandt has pointed out, simply quoting the US Founding Fathers could be considered "terrorism" in light of the recent array of civil liberty abuses.

According to Business Insider, "The Rutherford Institute stated that Raub has been "detained against his will due to alleged concerns by government officials that his Facebook posts are controversial and 'terrorist in nature'' and are arguing that "the detainment order was procedurally improper, the result of an unlawful detention, and was based entirely on statements made by Raub that constitute protected free speech under the First Amendment."

Supporters argue that some of the more violent Facebook posts by Raub – such as "Sharpen up my axe; I'm here to sever heads." – are lyrics from rap songs.

John W. Whitehead, president of The Rutherford Institute, said: “This is not how justice in America is supposed to work—with Americans being arrested for doing nothing more than exercising their First Amendment rights, forced to undergo psychological evaluations, detained against their will and isolated from their family, friends and attorneys. This is a scary new chapter in our history.”
Raub's unconstitutional detention is a sign that Raub's writings are in fact true, that the government is becoming increasingly abusive. Washington's blog has outlined how the government has been widening its definition of mental illness. This, coupled with the recent passing of the NDAA, is truly frightening to consider. It seems a person can now be abducted and labeled as mentally ill by some authority figure, then imprisoned as a threat to society and locked up indefinitely without a trial. Nice.

As Christians, no matter how outrageous the system of government becomes, we are to be salt and light standing for truth and speaking out about justice in an increasingly corrupt world. If we abrogate our nature as light and truth bearers, we are essentially denying the Christ nature within us and living disingenuous lives.     When asked about why Raub was placed in a psychiatric ward, FBI Richmond spokeswoman told us that the FBI "had nothing to do with that" and that the FBI typically doesn't "make determinations such as that."

    "We went out to interview him because of complaints that our office had received about people coming across his posts and perceiving them as threatening so our office along with Chesterfield County Police Department on Thursday," Rybiski told us. "When we left we had not arrested him, we had not placed our hands on him, we did not detain him and we did not charge him."

    Secret Service spokesman Brian Leary said: "The Secret Service assisted the FBI with the interview. He was not arrested by the Secret Service. The Secret Service will continue to monitor the situation. We have no further comment at this time."

    The Chesterfield PD – who had previously said the situation "was an FBI matter and we were just there to assist them" – released this statement (emphasis ours):

    Chesterfield Police assisted federal authorities in their efforts to interview Brandon J. Raub on Thursday, Aug. 16. After speaking to Raub, officers believed him to be in need of further evaluation.

    Chesterfield officers at the scene contacted Chesterfield Mental Health Crisis Intervention. Crisis workers recommended that police take Raub into custody and bring him in for evaluation.

    Chesterfield police took Raub into custody for evaluation in accordance with Virginia State Code § 37.2-808 Emergency custody.

    Raub was placed in handcuffs after he resisted officers’ attempts to take him into custody.

    Raub was evaluated by a Chesterfield mental health official, who determined that he should be held under a temporary [detention] order and transported to John Randolph Medical Center for additional evaluation.

    Raub was not arrested and he faces no criminal charges in Chesterfield.

    The Virginia statute states that a magistrate "shall issue, upon the sworn petition of any responsible person, treating physician, or upon his own motion, an emergency custody order when he has probable cause to believe that any person (i) has a mental illness and that there exists a substantial likelihood that, as a result of mental illness, the person will, in the near future, (a) cause serious physical harm to himself or others as evidenced by recent behavior causing, attempting, or threatening harm and other relevant information, if any, or (b) suffer serious harm due to his lack of capacity to protect himself from harm or to provide for his basic human needs, (ii) is in need of hospitalization or treatment, and (iii) is unwilling to volunteer or incapable of volunteering for hospitalization or treatment."

    The "interview" with the authorities was conducted due to his posts on Facebook.

    As Whitehead has noted,

    Nope, no contradictions at all. The reason why he was investigated (complains on his FB posts which were most likely violent in nature) and the reason why he was put into custody (recomendation from a crisis worker) are not the same.

  6. So, apparently, you do not deny that the interrogation was initially the result of a Facebook post. Yes, and quite a swift transition from interrogation to custody and confinement.

    As pertains to the present NDAA, this is extremely alarming.

    According to the NDAA, passed 12/31/11, The US government has granted itself the right to indefinitely detain and torture US citizens with no trial whatsoever. Look into the NDAA. Once a person is labelled an "enemy combatant" by some unknown insiders, that's it, according to the NDAA.

    - Personally, I find this approach outrageous. A person can have a complaint made against him. Some "expert" can claim a person is mentally unfit and a threat to society. And then, with no trial, the person can be locked up indefinitely. That's not the America I grew up in.

    As Washington's Blog outlines, the government has been providing a wider definition of mental illness in order to widen control:

    Shadow Health Secretary Andrew Lansley said: “The Government is trying to bring in a wider definition of mental disorder and is resisting exclusions which ensure that people cannot be treated as mentally disordered on the grounds of their cultural, political or religious beliefs.

    “The use of mental health powers of detention should be confined to the purposes of treatment. But the Government wants to be able to detain someone who is mentally disordered even when the treatment would have no benefit.

    “Combined with the idea that someone could be classed as mentally ill on the grounds of their religious beliefs, it is a very worrying scenario.”

    Indeed, the whole “indefinite detention” process (which Americans living on American soil are subject to) can be based on circular reasoning:

    The government’s indefinite detention policy – stripped of it’s spin – is literally insane, and based on circular reasoning. Stripped of p.r., this is the actual policy:

    If you are an enemy combatant or a threat to national security, we will detain you indefinitely until the war is over

    It is a perpetual war, which will never be over

    Neither you or your lawyers have a right to see the evidence against you, nor to face your accusers

    But trust us, we know you are an enemy combatant and a threat to national security

    We may torture you (and try to cover up the fact that you were tortured), because you are an enemy combatant, and so basic rights of a prisoner guaranteed by the Geneva Convention don’t apply to you

    Since you admitted that you’re a bad guy (while trying to tell us whatever you think we want to hear to make the torture stop), it proves that we should hold you in indefinite detention

    Correction - violent posts, as in plural. Which likely have nothing to do with the one you quoted in the article.

    So you are ok with a person snapping and starting shooting left and right innocent bystanders? Are you against preventive measures?

    1) He had a trial that decided putting him into custody was the right thing to do and his psychiatric evalution should be prolonged.

    2) He was not locked up indefinitely. He is being evaluted for now.
